| HAUPTMANN TRIALThe entire nation was stunned and grief-stricken at the circumstances of the kidnapping in 1932 of the infant son of one of our greatest heroes. On March 1, famed aviator Charles "Lucky Lindy" Lindbergh sat in front of a roaring fire with his wife, Anne. They were unaware that their son, Charles Jr., was being abducted from his nursery upstairs. A nursemaid went to check on the sleeping baby and was shocked to see an empty crib. The Lindberghs discovered the nursery window open, a ladder leaning next to the building, and a ransom note on the windowsill demanding fifty thousand dollars. News of the kidnapping spread, and hundreds of reporters and photographers descended on the Lindbergh estate. As concerned Americans attempted to help bring the Lindbergh baby home, the police were deluged with suggestions, tips, and false leads. A man in the Bronx named John F. Condon offered to help pay the ransom, and published his statement in his hometown newspaper. To his surprise, he was contacted by the kidnappers, who arranged with Condon for delivery of the ransom. In exchange, Condon received a note telling the Lindberghs their son was on a boat named "Nelly." Sadly the information proved false—they were not able to find the boat, or the baby. Two months after the kidnapping, the baby's body was found in the woods near the Lindbergh home. Americans were horrified, and investigators redoubled their efforts to find those responsible. Eventually, the police were able to locate one of the bills paid in the ransom. As more of the bills began to appear around the metropolitan New York area, investigators got a lucky break when one of them showed up with the license "4U-13-41" written on it, which was registered to a man named Bruno Richard Hauptmann. Police searched Hauptmann's home and found $14,000 in bills from the ransom, binoculars, New Jersey maps, and a sawed-off floorboard that matched the wood used to make the ladder outside baby Lindbergh's window. Hauptmann was questioned by the police for two days, during which he was beaten until he collapsed. But he did not confess. Instead, he claimed a friend of his named Isidor Fisch had given him a shoebox with the bills in it before Fisch returned to Germany. Fisch had since died of tuberculosis, so there was no way to verify Hauptmann's incredible story. Hauptmann was indicted for murder, and his trial began on January 2, 1935. The Hearst Corporation, in exchange for exclusive rights to Hauptmann's story, paid for a defense lawyer named Edward Reilly. New Jersey's attorney general David Wilentz prosecuted the case. Public interest in the case had not subsided, and six hundred members of the media gathered daily around the courthouse, collectively telegraphing over three hundred thousand words every day. The courtroom was also filled with spectators, literary figures, motion picture cameramen, and radio broadcasters. The prosecution, building on a public perception that Hauptmann was guilty, presented a strong case, including witnesses who saw Hauptmann with a ladder in his car, and another who saw Hauptmann walking in the woods near the Lindbergh estate. Even Condon identified Hauptmann as the person who took the ransom. Although Hauptmanns lawyer tried to defend his client, he did not successfully refute the prosecutions case, and the jury found Hauptmann guilty and sentenced him to death. He was executed on April 3, 1936, almost four years after the Lindbergh baby had disappeared. This case continues to attract attention to the present day, and scholars have scoured FBI files obtained under the Freedom of Information Act. Although Hauptmann did possess the ransom money, FBI files reveal that many of the prosecutions witnesses should not have been trusted—one witness was practically blind, and witnesses who might have aided the defense were persuaded not to testify. For several months after his arrest, police had access to Hauptmanns apartment, and ample opportunity to manufacture evidence. Additionally, legal scholars debate the legitimacy of the felony-murder charge used to execute Hauptmann. Although the ransom money could have linked Hauptmann to the kidnapping, it did not prove he committed the murder.
