| SAM SHEPPARDSam Sheppard was not a famous man in 1954 when his wife Marilyn was attacked and beaten to death in their suburban Cleveland home. But his story would soon become well-known as the basis of the popular 1960sTV series "The Fugitive," which was also made into a 1993 movie starring Harrison Ford, as well as a current TV series. The premise behind the original television show was that the title character fled justice in order to find the "one-armed man" who had killed his wife. In reality, Sam Sheppard claimed to have struggled with a "bushy-haired" intruder the night his wife was murdered. Sheppard claimed that on the night of the murder, July 4, 1954, he was awakened by his wife's terrified voice. Running to her aid, he struggled with the intruder and was knocked out. When he woke up, he found his wife had been murdered. The police found no signs of an intruder, and arrested Sheppard for the crime. His trial began in October, and he was convicted and sentenced to life in prison. When Sheppard's lawyer died in 1961, the family hired prominent attorney F. Lee Bailey to press for an appeal. Bailey was ultimately successful, convincing the U.S. Supreme Court that the extensive media coverage of Sheppards trial had biased the jury. After twelve years in prison, Sheppard was released and he prepared to face a second trial. Judge Francis Tilty, who presided over Sheppard's second trial, issued severe restrictions on the media, as well as sequestered the jury. This time around, Sheppard was found not guilty. Unfortunately, his life would never be the same. He became addicted to drugs and alcohol and his second marriage failed. He died in 1970 from liver failure. His son, Sam Jr., took up his father's cause and began a campaign to prove to the American public that his father was innocent. In 1993, investigators found an important item among the trial exhibits: a vial containing a small blood-stained sliver of wood that could be tested for DNA. Sheppard suspected Richard Eberling, who had access to the Sheppard home as a window washer, of being the real killer. Eberling, who was serving time in prison for another crime, gave a blood sample. Forensic scientists found Eberlings blood to be "consistent" with the blood found on the sliver, but Eberling claimed he cut himself while washing windows. Sam Sheppard, Jr., called on prosecutors to re-open the case, since it was technically listed as an unsolved crime, and in early 2000, he received another chance to prove that his father was wrongly convicted. Over a ten-week period, a Cleveland jury heard evidence in the Sam Sheppard case, including seventy-six witnesses and hundreds of exhibits. Sheppard's lawyer, Terry Gilbert, faced an uphill battle when the judge ruled that the defense could not mention Eberling as a possible suspect unless they tied him directly to the scene of the crime. On April 20, 2000, after less than six hours of deliberations, the jury returned with their verdict. Much to the surprise of courtroom observers and Sam Sheppard, Jr., the jury upheld the original conviction, which meant no one on the jury had been sufficiently convinced that Sheppard was innocent. Although we now have more information about the crime, we may never know for certain who killed Marilyn Sheppard.
